We often field calls from clients who have called other attorneys before consulting our firm. We encourage our clients to call around so they feel confident in their decision to hire an attorney.  Indeed, obtaining an occupational license is an important decision and one that should not be taken without research and inquiry into which attorney best fits the needs of the person seeking the occupational license.  A call to our office should make anyone feel confident that we can help them obtain an occupational license.

Daily, we receive calls from clients who have heard one thing or another about occupational licenses. We like to replace myths with facts, so here we will discuss some of the more common myths being spread around about occupational licenses.

Myth Number One: “An  Occupational License can only be used to drive to work and back.”

The truth is that occupational licenses can be used for more than work purposes if the petition and order are properly drafted.

According to 521.244 of the Texas Transportation Code, the judge who hears the petition for the Occupational License may determine if an “essential need” exists for an order granting the occupational license.  As defined by 521.241 of the same code, an essential need is: a need of a person to (1) operate a motor vehicle in the performance of his trade or occupation; (2) for transportation to and from the person’s place of occupation or trade; (3) to and from an educational facility in which the person is enrolled; (4) in the performance of household duties.

As you can see from the statute, an occupational license is more than a bus ticket to your job only. You can use it to go to school and to complete the essential needs of maintaining your home, such as buying groceries, going to the bank, or attending church.

The important thing to remember is that the laws which regulate the terms of an occupational license have been proffered by our law makers and while an occupational license is not the same as a regular drivers license, it can meet the needs of most people while their driving privileges are administratively suspended.
